Navigating the Complexities of Dual Nationality for Zambians in the UK: A Guide by N & M Immigration Lawyers

In 2016, Zambia introduced the Dual Nationality Act, a landmark change celebrated by Zambians worldwide. This Act allows Zambian nationals, particularly those in the diaspora, to retain their Zambian citizenship while acquiring citizenship in their country of residence. The benefits are substantial, enabling Zambians to contribute economically to their homeland through investments and facilitating seamless family connections by allowing visa-free travel between Zambia and their second country of citizenship.

However, while the Dual Nationality Act offers numerous advantages, it has also created challenges, particularly for Zambians residing in the UK. To renew a Zambian passport under this new law, individuals must present proof of their UK immigration status to the Zambian Embassy. The accepted proof is the Biometric Residency Card (BRP), which is a modern document reflecting the holder’s current status in the UK.

Unfortunately, many Zambians who settled in the UK before the introduction of the BRP are faced with a dilemma. Their settled status in the UK is recorded on an old vignette, a physical sticker placed in their now-expired passport. The Zambian Embassy no longer accepts this vignette as proof of status, assuming that individuals with settled status in the UK would have applied for British citizenship after holding Indefinite Leave to Remain (ILR) for one year. However, this assumption does not account for the many Zambians who, for various reasons, have not applied for British citizenship.

This situation leaves many Zambians in a difficult position. Without a valid Zambian passport, they cannot apply for British citizenship. To complicate matters further, some individuals who came to the UK as children may never have obtained a Zambian Registration Card, a document that can only be issued in person in Zambia. This requirement poses significant challenges for those unable to travel due to lack of support, the death of their parents, or health reasons. As a result, many Zambians find themselves in a precarious position, unable to prove their status in either country, effectively rendering them stateless.
